1. Acceptance of These Terms

By accessing or using the DesignlensUX website, platform, tools or services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree, you must not use the Platform.

These Terms apply to all visitors, registered users, customers, and businesses (“Users”).

2. About DesignlensUX

DesignlensUX provides AI-powered digital experience analysis, including:

  • AI-based UX Benchmarking

  • User Journey Analysis

  • Detailed UX & UI Reports

  • Website Designing Services

  • UI Testing

  • Account login & dashboard

  • File/design uploads for evaluation

  • API access (where applicable)

All services are accessible through the DesignlensUX Platform.

3. Eligibility

The Platform is intended for:

  • Individuals aged 18+, and

  • Businesses/organizations

By using the Platform, you confirm you meet eligibility requirements.

4. User Accounts

4.1 To use certain features, you must create an account.
4.2 You agree to provide accurate information and keep it updated.
4.3 You are responsible for maintaining confidentiality of login credentials.
4.4 Any activity from your account is considered authorized by you.

We may suspend or terminate accounts for:

  • Uploading restricted or illegal content

  • Abuse or misuse of tools

  • Legal/compliance obligations

  • Security concerns

5. Services Provided

DesignlensUX’s services include both automated and manually generated insights.

5.1 Report Delivery

  • Some reports may be generated instantly.

  • Most reports are currently prepared manually powered by AI.

  • Delivery times vary depending on report type, volume, and complexity.

DesignlensUX does not guarantee delivery within a specific time unless explicitly stated during purchase.

6. Payments, Refunds & Cancellations

6.1 Payment Terms

  • Payments are accepted in INR only.

  • We offer tiered subscription plans and one-time report purchases.

  • Payments are securely processed through Razorpay.

  • You authorize us to charge your payment method for all purchases.

6.2 Refund Policy

Non-Refundable Services

The following services are non-refundable as they are digital, knowledge-based, and begin processing immediately:

  • AI-based UX Benchmarking

  • Detailed UX Reports

  • User Journey Analysis

  • Custom UX/UI evaluations

Once purchased, these services cannot be canceled or refunded.

Subscription Plans

Users may cancel within 24 hours of purchase for a full refund, provided:

  • No services have been used; AND

  • No reports or analyses have been generated.

If any service has been used, the subscription becomes non-refundable.

After 24 hours, no refund will be issued.

7. Acceptable Use Policy

Users must not upload, submit, or use the Platform to share:

  • Illegal content

  • Copyrighted content they do not have permission to use

  • Malware, bots, or harmful scripts

  • Content that violates someone’s privacy or rights

Competitor website scanning is allowed, but the User must ensure they have legal rights to evaluate any URL they submit.

We reserve the right to remove content or terminate accounts violating these rules.

8. AI-Generated Content Disclaimer

DesignlensUX uses AI technologies (including Google Vertex AI, Gemini, OpenAI models, and internal automation) to provide benchmarking, analysis, and recommendations.

AI Limitation Notice :

  • AI insights are estimates based on available data.

  • Reports may contain inaccuracies or incomplete interpretations.

  • Benchmark comparisons are approximations, not guarantees of performance.

  • DesignlensUX does not guarantee outcomes, business results, conversions, or improvements based on AI insights.

Users must independently verify critical findings.

DesignlensUX is not liable for decisions made based on AI outputs.

9. Intellectual Property

All materials on the Platform—including AI models, benchmarking methods, scoring parameters, text, graphics, logos, tools, and algorithms—are the exclusive property of DesignlensUX.

Users may not:

  • Copy

  • Modify

  • Reverse-engineer

  • Sell

  • Distribute

  • Reproduce

  • Use for competing services

DesignlensUX retains full ownership of all IP.

10. User Content

When you upload files, designs, URLs, or other materials:

  • You confirm you own or have rights to use them.

  • You grant DesignlensUX a non-exclusive, royalty-free license to analyze and process them solely to deliver services.

  • We do not claim ownership of your content.

We may delete your uploaded content after report delivery or after your account is closed.

11. Service Modifications

DesignlensUX may:

  • Add or remove features

  • Update scoring models

  • Improve or modify the Platform

  • Change pricing or plans

Changes may occur without prior notice.

We are not liable for any discontinuation or modification of services.

12. Limitation of Liability

To the maximum extent permitted by law:

  • DesignlensUX is not responsible for business losses, revenue loss, website ranking changes, UX performance, or outcomes from reports.

  • We are not liable for:

    • AI inaccuracies

    • Delays in service

    • Data loss

    • User misuse

    • Third-party failures (Razorpay, hosting, analytics tools, etc.)

Total liability for any claim will not exceed the amount paid by the user in the last transaction.

13. Third-Party Tools

We use third-party services including but not limited to:

  • Wix

  • Google Cloud Platform

  • Google Analytics & Tag Manager

  • Razorpay

  • LinkedIn

  • GitHub

  • Google Workspace

  • OpenAI / Gemini / Vertex AI

Your data may be processed by these providers according to their policies.

14. International Data Transfers

Since we use globally hosted services (Google Cloud, Wix, OpenAI), your data may be transferred to servers located outside India (including the U.S.).

We take reasonable measures such as encryption and secure protocols to protect your data.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India, specifically the jurisdiction of Himachal Pradesh.

Any disputes will be resolved in courts located in Himachal Pradesh, India.

16. Termination

We may suspend or terminate your access if:

  • You violate these Terms

  • You upload restricted content

  • You misuse the Platform

  • We receive legal or compliance orders

  • You attempt security breaches

Upon termination, your account and associated data may be deleted.
